Protecting the Voting Rights and Autonomy of Vulnerable Residents in Long-Term Care Facilities
CMS has issued updated guidance reminding nursing homes and skilled nursing facilities that residents have the right to vote, or to decline to vote, without interference, coercion, discrimination, or reprisal. The memo also warns facilities to comply with federal and state election laws and encourages the use of bipartisan election workers where state law allows. Because surveyors will be citing facilities against these standards, long-term care communities should align their voting policies and procedures now.
This guidance reinforces existing obligations, but its message could not be clearer: protecting voting access and protecting each resident’s autonomy must go hand in hand. Residents, families, administrators, and staff all have a stake in getting this right. Facilities should review their voting policies, procedures, and staff training now to ensure they align with CMS recommendations.
